1) Agreement to Terms
By accessing our website, requesting a quotation, purchasing, installing, using, or subscribing to any iKnowHow products or services (collectively, the “Services”), you agree to these Terms.
If you are using the Services for an organization (e.g., a corporate fleet or security institution), you represent that you have authority to bind that organization.
2) Our Services
We provide vehicle safety, security, and surveillance solutions including (as applicable): vehicle-mounted cameras/MDVR systems, live audio/video surveillance, driver monitoring (fatigue/distraction), ADAS alerts, incident/accident reconstruction tools, and related reporting/alerting features.
Some deployments may be hosted within Bangladesh and/or installed inside a customer’s own infrastructure depending on the package and contract.
3) Quotes, Orders, Installation, and Support
- Quotes & orders: Quotes and invoices are valid only for the period stated on them. Taxes/fees (if any) may apply.
- Installation: Installation requirements (vehicle compatibility, camera count, wiring, storage media, etc.) will be defined in the quotation/SOW.
- Support: Support availability, channels, and any SLA are defined in your contract/AMC (if purchased).
4) Customer Responsibilities
You agree to:
- Use the Services lawfully and obtain all required permissions/consents (especially for recording audio/video and driver monitoring).
- Ensure drivers/operators are informed about monitoring/recording where required by law and workplace policy.
- Keep your account credentials and devices secure and prevent unauthorized access.
- Provide suitable power, connectivity, and physical installation conditions for equipment.
5) Acceptable Use
You must not:
- Use the Services for unlawful surveillance, harassment, stalking, discrimination, or any illegal purpose.
- Attempt to bypass security, access systems without authorization, or interfere with networks/devices.
- Reverse engineer, copy, modify, resell, or redistribute our firmware/software except as permitted in writing.
6) Alerts, AI Features, and Safety Disclaimer
AI/analytics features (e.g., fatigue or distraction detection, ADAS alerts, face recognition where offered) can generate false positives/negatives and are assistive tools, not a guarantee of safety or legal compliance. Drivers must always follow traffic laws and drive safely. Do not rely on alerts as the sole basis for any safety-critical action.
7) Data Access and Customer-Controlled Footage
Depending on your package and configuration, footage and related data may be stored on customer-controlled devices/servers, and access may require your authorization. Exact data handling is described in the Privacy Policy and your contract.
8) Fees, Payment, and Suspension
Payment terms are stated in your invoice/contract. If payments are overdue, we may suspend services/support after providing notice where practical.
9) Warranty and Returns
- Device warranty: Unless otherwise stated, devices/accessories may include a limited warranty (e.g., 1-year replacement warranty for certain products/packages).
- Service warranty: Services are provided with reasonable care and skill; however, network conditions and third-party dependencies can affect performance.
- Returns/refunds: Any cashback/return conditions (if offered) are governed by the specific offer terms, invoice, and receipt.
10) Intellectual Property
All trademarks, software, firmware, designs, documentation, and website content are owned by iKnowHow or its licensors. You receive a limited, non-transferable right to use them only as needed to use the Services.
11) Third-Party Services
Some functions may rely on third parties (e.g., email delivery, SIM/network providers, map providers). We are not responsible for outages or failures caused by third parties.
12) Limitation of Liability
To the maximum extent allowed by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, business interruption).
- Our total liability for claims relating to the Services is limited to the amount you paid to us for the specific product/service giving rise to the claim during the preceding 12 months, unless your contract states otherwise.
13) Indemnity
You agree to indemnify and hold iKnowHow harmless from claims arising from your unlawful use of the Services, including failure to obtain required consents for recording/monitoring.
14) Termination
We may terminate or suspend access if you materially breach these Terms or use the Services unlawfully. You may stop using the Services at any time; fees already paid are non-refundable unless required by law or stated in writing.
15) Governing Law and Disputes
These Terms are governed by the laws of Bangladesh. Disputes will be resolved in the courts of Dhaka unless your contract specifies arbitration or another venue.
16) Changes to Terms
We may update these Terms from time to time. Changes are effective when posted on our website, and continued use indicates acceptance.
